Last Will and Testament of George Benjamin Wallace
I, George Benjamin Wallace of County of Salt Lake, State of
Utah, being of sound mind and memory, hereby declare and publish this document
as my last will and testament.
1. It is my desire that my executors pay and discharge all
my just debts, as early as practicable without making sacrifice of my property.
2. I give and devise to my daughter, Martha M. Wallace
Perkins, five acres of my real estate, describe as follows: Commencing at the
Southeast corner of the northeast quarter of Section 5, Township 2 South, Range
1 West, Salt Lake Meridian; running thence west 40 rods; thence North 20 rods;
thence East 40 rods; thence South twenty (20) rods, to beginning.
3. I give and bequeath to my son, James B. Wallace, the two
family portraits (paintings) of myself and his mother, Mary C. McMurphy
Wallace.
4. It is my desire that all of my family relics, including
my gold watch, be distributed by casting lots, among my children.
5. It is my desire that as soon as practicable, the five
acres herein before devised to my daughter, Martha M. Perkins, be set apart, to
her and placed under her control.
6. It is my desire, and I hereby give authority and direct
that my executors, shall sell and convey the whole of my real estate or any
part thereof, whenever they, or a majority of them, shall deem a sale thereof
to be beneficial for the interests of my estate, without an order of Court, and
to apply the proceeds in payment of the debts of my estate, or distribute them
as herein provided.
7. I direct that as soon as my executors shall sell my real
estate, and pay the debts against my estate, that the residue shall be
distributed among my children and grandchildren, as follows, to-wit: To my
children, James B. Wallace, Melissa Wallace Liston, John King Wallace, Howes
Crowell Wallace, George Edward Wallace, Lydia D. Wallace White, Joseph D.
Wallace, Daniel Spencer Wallace, Emily D. Wallace Hancock, Josiah D. Wallace,
Dorothy D. Wallace Dudley, George Alfred Wallace, Thomas D. Wallace, Ida D.
Wallace Cochrane, Noble Wallace, Lucy D. Wallace McIntyre, Mary E. Wallace
Garret, George Benjamin Wallace, Jr., Lois D. Wallace Watson, William D.
Wallace, Alonso D. Wallace, Zena D. Wallace Little, Henry D. Wallace, Arthur N.
Wallace, Maud D. Wallace Barrett, Samuel D. Wallace, one twenty-eighth (1/28)
each; to my granddaughter, Hannah Etta Carlisle 1/28; to my grandchildren Edith
Eaton (whose married name is unknown to me); and Herbert Eaton (children of my
daughter Sarah Ellen Eaton, deceased) 1/56 each.
8. I direct and give full authority to my executors to sell,
convey and dispose of any and all personal property, not otherwise provided
for, and apply the proceeds in pursuance of the directions of this Will,
whenever, in their judgment, it shall be beneficial for the interests of my
estate.
10. I hereby nominate and appoint my sons, Samuel D.
Wallace, George Benjamin Wallace, Jr., and Joseph D. Wallace, as the executors
of this my last will and testament, and request that they be not required to
furnish bonds as such executors.
11. I hereby revoke any will or wills heretofore made by me
at any time.
